By using EverNear ("the Service"), you agree to the following terms. Please read them carefully.

What EverNear Does

EverNear is an AI-powered portrait generation service. You upload two photos and our system generates a new portrait depicting both individuals together. The resulting image is an AI-generated creation — it is not a real photograph and should not be represented as one.

Your Photos

You must have the right to use any photos you upload. By uploading photos, you confirm that:

• You own the photos or have permission to use them
• The photos do not violate anyone's privacy or intellectual property rights
• You will not upload illegal, harmful, or inappropriate content

We reserve the right to refuse service if uploaded content violates these terms.

Generated Portraits

Once you purchase a portrait, you receive a license to use the generated image for personal, non-commercial purposes. This includes printing, framing, sharing with family, and posting on personal social media. You may not resell generated portraits or use them for commercial purposes.

AI Limitations & No Quality Guarantee

AI-generated portraits are not perfect. Results vary based on the quality, resolution, lighting, and characteristics of the photos you provide. We do not guarantee that any generated portrait will achieve a particular likeness, accuracy, or level of quality. While we strive for the best results possible, the nature of AI generation means that outputs may contain imperfections, artifacts, or inaccuracies. You acknowledge this before making a purchase.

We strongly recommend reviewing the watermarked preview carefully before purchasing. The purchased portrait will match the preview you selected.

Pricing, Payments & Refund Policy

Digital downloads are priced at $14.99. Framed prints vary by size and frame selection. All prices are in USD. Payments are processed securely through Stripe.

All sales are final. We do not offer refunds on digital downloads or framed print orders. Because you can review the watermarked preview before purchasing, and because the purchased image matches the preview you approved, we are unable to issue refunds based on dissatisfaction with the AI-generated result.

Framed Prints

Framed print orders are fulfilled and shipped by a third-party printing partner. EverNear does not manufacture, print, or ship framed products directly. We are not responsible for print quality, color accuracy, framing materials, or shipping delays beyond our control.

Once an order is submitted for production, it cannot be canceled or modified. If a print arrives physically damaged during shipping, contact us within 14 days at hello@evernear.me and we will work with our fulfillment partner to arrange a replacement. Replacements are limited to items damaged in transit and do not cover dissatisfaction with AI-generated image quality.

Acceptable Use

You agree not to use EverNear to:

• Generate portraits of individuals without their consent or the consent of their estate
• Create deceptive, misleading, or harmful content
• Circumvent rate limits or abuse the service
• Reverse-engineer or scrape the service

Service Availability

We aim to keep EverNear available at all times but cannot guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time. We are not liable for any loss resulting from service interruptions.

Limitation of Liability

EverNear is provided "as is." To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the specific portrait in question.

Changes to These Terms

We may update these terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
